Adults who would like to adopt children and are willing to make a lifelong commitment to the adopted children and in accordance with relative regulations of “Civil Code”.

 

 
Local Adoption

 

The applicant is required to make a written application addressed to the Director of Social Welfare Bureau and submits:

 

Photocopy of Macao Resident Identity Card of the applicant and his/her family members;

Document with the correct address (ex: water or electricity bill of present living place);

Other relevant documents of the application (For enquiry, please contact Children and Youth Service Division and also refer to the pamphlet “Legal Regulations Governing Adoption in Macao”.).

 

 

Social Welfare Bureau will evaluate adoption application, providing matching and counselling services, keeping in contact with relevant departments, submitting report to procuratorate and court, as well as following-up the adaptation and present living situation of the adopted person in the adoptive family.

 

 

The applicant is required to make a written application addressed to the Director of Social Welfare Bureau and submits:

 

Photocopy of Macao Resident Identity Card of the applicant and his/her family members;

Relevant Document indicating Chinese nationality of the applicant (ex: Macao SAR passport, or other personal data that specify Chinese nationality);

Photocopy of Mainland Travel Permit for Hong Kong and Macao residents (Home-Visiting Certificate for Compatriots from Hong Kong and Macao, in colloquial term);

Document with the correct address (ex: water or electricity bill of present living place);

Other relevant documents of the application (For enquiry, please contact Children and Youth Service Division and also refer to the pamphlet “Child Adoption in China by Macao SAR Resident with Chinese nationality”.).

 

 

Once being studied and confirmed that the applicant is eligible and suitable to adopt, a certificate will be issued by Social Welfare Bureau to serve as a proof of his/her ability to undertake an adoption (The valid period of the certificate is 120 days. If the applicant is of 60 years old within that period, the date of validity will be the day before he/she reaches 60 years of age.) During this period, he/she can go by himself/herself to China to select the child intended to adopt. In addition, he/she needs to submit application and make adoption register in local Department of Civil Affairs where the child’s permanent residence is registered, together with the above-mentioned certificate and relevant documents..

Declaration of Adoption Application:

It will be issued within 10 working days on receiving the letter of notification from the adoption applicant (Performance Pledge);

Social Report of Adoption:

The relevant study will be concluded within 60 working days upon emission of Declaration of Adoption Application. And the applicant will be informed of the decision (Performance Pledge).

The consent for the adoption has already been given by the parents of the prospective adoptee and by the prospective adoptee who has attained 12 years old, or its exemption if the relevant requirements for exemption are satisfied according to the stipulations prescribed by the law of Macao;

The local law should allow sufficient time for the minor and the applicant to live together, in order to decide whether they should establish an adoptive relationship;
The adoption will provide actual benefits to the adoptee, is based upon valid reasons, and on the reasonable prediction that the adoptee and the adopter will establish a quasi parent-child relationship;
In accordance with the local law, the prospective adoption can produce the same effects as those stipulated by the law of Macao;

Fees and Charges (or Tax)

 

Free of charge for services provided by the Social Welfare Bureau of the Macao SAR Government.

Judicial procedures, processing of documents of the to-be-adopted child, transportation charges, etc., are to be bored by the applicant for adoption.

Observations

 

“If the minor who resides habitually in Macao could be adopted in Macao, adoption by foreign citizen is not permitted.” (Decree N° 65/99/M of 25 October, Clause 162, n° 1). However, special conditions are exceptional.

After obtaining the authorization for judicial entrustment, the adotee shall be arranged to go abroad to live with the adoptive family for a trial period to decide whether they can establish a satisfactory adoptive relationship. During the trial period, the Social Welfare Bureau of the Macao SAR Government will work together with the authorized department of the place of habitual residence of the applicant to follow up the progress.

To provide the court with all kinds of support so that the minors will receive appropriate trial and obtain adequate protection.

 

 

In case that the court exercises judicial authority on minors, Children and Youth Service Division is also responsible for providing the court with assistance concerning cases of other types within the jurisdiction of social protection system, including exercise and norms of parental custody and guardianship; behaviour of a child under 12 that contravenes the law, a minor who experiences all kinds of crisis in the growth stage or social in-adaptation, such as cases of abandoned child, without family and extreme mal-adaptation to all kinds of disciplines or social life.

 

 

 

The court and the procuratorate will make referrals of the cases concerned to Children and Youth Service Division.

 

 

 

 

Social Service Centre in the neighbourhood where the residence of the applicant is located.

 

 

Home: Children and youth who cannot enjoy normal family care due to family problems and need children and youth residential service subsidized by Social Welfare Bureau.

 

Nursery: Children with family problem that need to be placed in nurseries subsidized by Social Welfare Bureau

 

 

 

The applicant is required to make an application at Social Service Centre in his/her neighbourhood and submits:

 

Photocopy of Macao Resident Identity Card of the applicant and his/her family members;

Salary declaration of family members;

Water or electricity bill of present living place, rent receipt/documents relating to housing loan and other expenses;

Other relevant documents of the application (For enquiry, please contact Social Service Centres).

After referral, all service charges incurred are to be determined by the institution and the client.

Overview

 

In accordance with Law No. 2/2007 of MSAR, “Education and Supervision Regime/System of Juvenile Offenders”, it stipulates the respective measures to be taken to educate juveniles who are legally found guilty of committing crimes or slight offences so that they can get integrated into the community in a proper and responsible manner. Besides juridical measures, police caution will be administered by Public Security Police Force too. During the police cautioning, if Public Security Police Force thinks that mere cautioning is not sufficient to serve its purposes, it will then inform Social Welfare Bureau about the relevant case for the Bureau to conduct in-depth assessment of these juvenile offenders, to evaluate if they have the need to participate in the Community Support Programme. From the findings of the assessment, for those juveniles who revealed having this need, Social Welfare Bureau will work together with the Community Youth Work Team to provide them with relevant services.

 

 

 

Objectives

 

Community Support Programme is aimed at helping juveniles who had been cautioned by police to correct their misbehaviour, make a new start and reduce their recidivism rate through counselling, education or training.

At the same time, the programme enables these juveniles to recognize the wrongdoings that they had committed were violations of law. These juveniles will then learn how to maintain self-control, respect others and their belongings, and encounter temptations from peer group.
